Approval of Agenda:  Commissioner Brazil made a motion to approve the agenda as written; Commissioner Booth seconded; unanimously approved.

Minutes: Commissioner Brazil made a motion to approve the regular port commission minutes from October 21, 2020, Commissioner Booth seconded, unanimously approved.

Vouchers:  There were no vouchers to approve

Public Communication:   M Purvis said that Port needs to take the highest levy every year as part of the budget.  K Wyatt said the port did take the highest levy this year which was 1.4% or $1,471.00.  H McCutchen said she reiterates support for the public restrooms. Commissioner Booth asked H. McCutchen what kind of funds can the Chamber contribute to help with the public restroom situation, isn’t there districts that contribute money to the Chamber for tourism? H McCutchen said the funds awarded the Chamber are specific to the visitors’ information and services. Commissioner Booth said wouldn’t services include public restrooms, doesn’t that approach doesn’t help with the cause.  H McCutchen said I am not willing to contribute funds to the public restroom. People pay membership dues. J Morris is a board member of the Chamber, she came to me to help with the public restroom situation in Hoodsport. I don’t often do things like this but the survey results reflect the community at large want the public restrooms.  Commissioner Brazil said, we will explore the LID. Commissioner Booth said in addition, isn’t that a great entrée to help Hoodsport find money for the public restrooms. H McCutchen said, if movement is made we will help with getting the word out. Again, I am not willing to pledge money from the Chamber. I will continue to show up at meetings until you find a solution.  Commissioner Brazil asked if anyone else had something they would like to say.  Lori Kincannon said I am here to learn and listen.  J Goodpastor said I am an interested resident here. 

Commissioner Reports    Commissioner Booth said she was in communication with Marine Floats on the dock repair, they said the invoice was two times the amount of what they thought because when they opened up the boards on the dock, it revealed much more damage.  We need to be looking at the next several years of dock repair.  The movement from the wind and water really beats the dock and mechanism holding it together.  YSS Dive shop filmed the port dock and floats which were encrusted with crustaceans and starfish.  You couldn’t see much because it was so cloudy in the water, it was like walking through an aquarium with no reference as to which portion of the dock we were looking at.  I forwarded the video to Marine Floats to look at.  M Purvis said I would like to see the video, this could be an opportunity to have the dive shop scrape off the pilings.  We have had several people move to town with great talents.  Maybe we can find someone who does grant writing and other talents on things we can’t do.  H McCutchen said I could put together a list of wants on expertise of people who volunteer their time for our community, I will put something together on our website.

Port Maintenance Reports:  

Hoodsport Trail Park & Disc Golf Park:  B Osborne said there is not much activity on the course lately. There has not been people dumping trash or abusing the permanent portable restroom. M Purvis said if people hit the garbage can, I am happy. No one approached us to volunteer to help with the bridges.  There have been of lot of mountain bicycling on the trails, mostly families.  What is the Ports position on the bicycling?  Commissioner Brazil said I guess its alright as long as there is no complaints. Commissioner Booth said as long as they are not off road motorcycles which can be dangerous to hikers. 

Hoodsport Marina, Dock & Waterfront Park: B Osborne said the ladders are on the dock, the irrigation system and water lines are winterized.  The hanging baskets are down so the Kiwanis can put up the candy canes on the poles.  B Osborne said the Fire Chief called, they are still going through a transition of combining two fire departments and after it is complete in January 2021, he will call back so we can create a scheduled inspection and testing of the fire lines on the dock.

Public Restrooms: Currently closed to the public both as directed by Mason County because of a failed drain field and due to the COVID 19 pandemic for health and safety of the public and personnel. An ADA and 2 Portable restrooms with hand washing stations are available for the publics use. Portable restrooms are serviced Monday and Fridays in winter months. They are serviced additionally when needed. Maintenance personnel monitors garbage and supplies additional toilet paper as needed.

Port parking/Office building/Maintenance shed: B. Osborne and S. Lindgren have Security App’s on their phones to monitor live stream surveillance cameras overlooking the public restrooms, office building, shed, parking lot, waterfront park and the dock.

Port Directors Report

A Facility Use Agreement between the Port of Hoodsport and YSS Dive Shop has been reviewed by the port’s attorney and will be sent back to YSS for their input when Exhibit ‘A’ is finished to attach, B Osborne is drawing a map to attach to the Facility Use Agreement as Exhibit ‘A’. 

Governor Inslee extended the OPMA guidelines and is changing dates as the COVID Crisis develops, Mason County opened the county up to Phase III which allows people to gather in groups of 50 or less, wear face masks, and social distance six feet away. Due to the most recent Governors mandate, COVID-19 health and safety compliance signs are posted on all port properties for the public’s information and on the office window.  The Port of Hoodsport port commission continues using the ‘Zoom’ virtual chat room venue for regular port commission meetings during the COVID-19 pandemic, the public can request an invite to attend the meetings.  Meeting dates are posted on the port’s website, on Mason TV, in the WPPA newsletter and posted on the port office window. Currently, the public may email the port for an invitation to attend the regular port commission meeting.  The request must be received by 4pm the day prior to the scheduled meeting.

Public Communication:   M Rothrock started writing a press release but was wondering who the audience will be. Commissioner Brazil said we want to gain exposure by attracting people from other areas as well as Mason County. We want people to be introduced to the course describing it in detail with the course rating. M Rothrock said he will clean up the current version of the write up and include some of the reviews from the disc golf website chatroom and should have a rough draft within a week. In looking at the online chats on the disc golf course review, the course was set to ‘live’ a couple of weeks ago, then updated with the proper T type and hole type.  The current rating is 3.88 which is a 4-star rating, really good for a 9hole course.  Getting the concrete T pads in was big because people look for concrete T pads when they are searching for a course to play on their APP.  M. Rothrock said Hoodsport Hills disc golf course will be one of the courses campers will use as an activity in their rotation of things to do while in the Hoodsport area.  It would be nice to see the pro shop and/or outfitters shop have disc golf ‘kit rental’ with a bulletin board showing where the disc golf course is and a layout of the course.  I am going to reach out to Shannon for design ideas for a master map of the course, T signs to place at the T pads and a large sign for the parking lot, all aesthetically matching.  Commissioner Brazil said B Grondin, the course warden has ideas on nighttime disc golf tourneys with glow sticks to light up the baskets and glow in the dark discs.  M Rothrock said there are battery operated lights that can be reused and would be perfect to light up the baskets.  J Morris said she was attending to find out about the public restrooms.  H McCutchen said she spoke to Commissioner Brazil regarding the public restroom issues, went over the survey and wrote an article about the public restrooms through the Chambers online website where people who took the survey said they want the public restrooms and they are a high priority.  The Chamber will do what they can to help find a solution.  H McCutchen said she can send references on a septic designer. J Morris asked if the port is working to find another septic designer, she said she’s used Arrow who were expensive and took a long time but did a great job.  Commissioner Brazil said, first the land for the drain field must be determined. The port director said M Purvis will be present at the next regular port commission meeting, he is the landowner who can offer suggestions.  J Morris said why can’t we use part of the County land and part of the Purvis land?  Commissioner Booth explained that the County property had a perc test and the soil was not adequate, also the adjacent homeowners were not in favor of using the County land because the drain field would be within a 100’ setback of an existing well and finally they did not want a community drain field near their properties.  B Osborne said we dug test holes and the septic designer said the soil did not perc, it was not good, there were too many rocks and not enough soil, and it would require an expensive treatment, that is the reason why our current septic drain field failed. Commissioner Brazil said once a property is identified, a septic designer has to be hired, a perc test has to be done,  there is a septic design fee, county permitting and depending on the type of the drain field and treatment, someone will have a large sum of money to correct the situation.  Designing and installing a drain field would bust the ports budget.  The port has other issues to pay attention to as well, the port’s dock needs repair after every winter, we just do not have the money in this port districts small budget.  Commissioner Brazil said he met with a reporter from the Shelton Journal newspaper who got a call from a concerned person.  We had a nice conversation and now the reporter knows what the public restroom issues are.  He was very helpful and suggested there may be some way to find COVID money to help with servicing and maintaining the restrooms.  Commissioner Brazil asked H. McCutchen if the Chamber has money to help with the drain field or servicing and maintaining the public restrooms. H McCutchen said, no, we don’t, we are only interested in helping you find grants.  Commissioner Brazil said the first step is to find the land to install the drain field, then to talk to a septic designer, then find an organization to surplus the restrooms to who can build a drain field, take it over and run it.  H McCutchen asked the port director for figures of what it cost to run the public restrooms since they were installed.  The port director said those figures will not reflect what the current costs are to operate the public restrooms because the number of users in the last few years have far exceeded the number of users from 2013.  The public restroom septic tank will now have to be pumped periodically even if there is an alternate drain field because the overwhelming number of users far exceeds the capacity of the design of the septic system and drain field.  Pumping the septic tanks once per month and before and after every major holiday will become normal so the septic system does not fail.  J Morris said she may have to wait until September to have the Fjordin Crossin event next year because of COVID.  We are going into the second wave; I am hoping for a vaccine to create herd immunity.  Last year I obtained permission from the school and had transportation, we will just have to wait to see what happens.  H McCutchen said how do we replace Commissioner Petz?  The port director said we put an ad in paper for interested parties to who live within the port district to submit a resume for the port commission to review.  The commission has 90 days from when Commissioner Petz resigned on October 6th to fill his position and serve out his remaining term until 2023.

Hoodsport Trail Park & Disc Golf Park:  B Osborne said the course is functional, people are playing it.

Hoodsport Marina, Dock & Waterfront Park: B Osborne said there was not a leak, someone opened the valve to the water pipe on the dock, he will put a lock on it.  Commissioner Brazil asked if the fire department drained down the pipe.  B Osborne said he didn’t think they charged the water line this year.  Commissioner Brazil said the fire chiefs have changed and will probably need to be reminded that they should charge the fire line in the spring and drain it down in the fall, they should do a pressure check in the spring, B. Osborne will you remind them that should put it on their annual calendar.  B. Osborne said yes, he would go ahead and open the valve to drain it down.  Commissioner Booth asked B. Osborne if the ladders have been installed on the dock, he said, not yet, it won’t take long to do it.

Port Directors Report

A Facility Use Agreement between the Port of Hoodsport and YSS Dive Shop has been reviewed by the port’s attorney.  B Osborne is drawing a map to attach to the Facility Use Agreement as Exhibit ‘A’.  J Morris asked if she needed another Facility Use Agreement with the Dive shop to hold her Fjordin Crossin event.  The port director said the Facility Use Agreements are between Vendors and the Port of Hoodsport.  She suggested that J Morris speak to YSS Dive Shop as a courtesy to let them know when J Morris will have her annual event and the areas she plans to use.  A preliminary budget was reviewed showing year to date costs, the Auditors office requests the Final budget for 2021 be submitted by November 30th.  The port of Hoodsport will review a Preliminary 2021 budget for approval on November 11th at 9am.   The long-term management forest practice application submitted to DNR was approved for the first step in the Hoodsport Trail Park forest management plan. Interested parties have had the opportunity to comment and review the resources and agreed the proposal is sound. The second step which is to thin occasionally is submit with maps to DNR for review and approval.  Commissioner Brazil will need to sign the authorization allowing DNR to enter the property to review the proposal, inspect harvest operations and monitor compliance.

2020 October 7, Virtual Regular Port Commission Minutes

Minutes: Commissioner Brazil made a motion to approve the regular port commission minutes from September 16, 2020, Commissioner Booth seconded, unanimously approved.

Vouchers:  Commissioner Brazil made a motion to approve the Vouchers 1of1 October 7, 2020 for $7,278.47, Commissioner Booth seconded, unanimously approved.

Public Communication:   J. Morris wondered if the port commission thought she would be able to have the Fjordin Crossin event this June because she typically has everything lined up by now.  Last year we  coordinated with Mason Transit and had offsite parking at the school,  We have not done anything this year because of COVID-19 and I can’t wait until the last minute.  Commissioner Booth said the Governors proclamation says to follow protocol, we can only have gatherings of up to 50 people.  J Morris said, I think we would have a huge turnout because everyone will want to be outside.  Commissioner Brazil said we will support you if you have approval from governing authorities.

Commissioner Reports:  The Port director said we received an email late yesterday from Commissioner Petz, he said, ‘I hereby resign as a Commissioner for the Port of Hoodsport effective as of the date of this email”, the email was dated October 6, 2020.  The port director said we must appoint a new chairman of the board.  Commissioner Booth said I nominate Commissioner Brazil to be the new chairman, Commissioner Brazil said, I accept, the motion carried.  Commissioner Booth asked if Commissioner Petz indicated anything else, the port director said he has been talking about it for a couple of years, there may have been a health issue in the family, he has been a port Commissioner since 2009.  Commissioner Brazil asked when his term would be up, the port director said his term expires in 2023, we have 90 days to appoint someone to replace him. Commissioner Brazil said, he will certainly be missed.  J. Morris said, I am very sad, he did a lot of work for the port.  Are you going to have a function for him, I would like to have a celebration to thank him and will host it.  Commissioner Booth said, he is very cautious of COVID-19 and hardly leaves his house, you may want to call him to find out first.  Commissioner Brazil said he spent a couple of hours with B Grondin, the course warden at the Hoodsport Hills disc golf course.  The T pads that were created to launch the discs are perfect, wide in the rear and they narrow in the front.  There is new bark, rock and volunteers to help from people in the disc golf community.  Commissioner Booth asked if Commissioner Brazil played the course, he said no. Commissioner Booth said she attempted it but spent lots of time in the woods chasing her disc.  S. Lindgren said there are lots of people using the disc golf course.  Commissioner Brazil said he would like to get publicity for the disc golf course. L. Kincannon said she is in marketing and could definitely help out with issuing a press release to local radio stations and papers that would travel far and wide with online versions.  The port director said she will contact M Rothrock to find out if he can attend the next port meeting so talk about upcoming events and tournaments, he could create a press release.  S. Lindgren said Mason County Sheriff’s department are in the office now reviewing the ports surveillance footage to identify suspects that drove by in connection with a murder at FS Road 24.  Commissioner Booth asked B Osborne if the dock ladders have shown up yet.  B. Osborne said yes, they are in the office, they are heavy duty, we will install them on the first set of dock fingers closest to the shore.  Commissioner Brazil asked if YSS Divers were able to see ladders under the dock?  B. Osborne said yes the arms on the ladders are broken off, one of them is by the shed. Commissioner Brazil said how do you feel about putting a sign where the ladders will be installed so if someone falls in the water they will know where they are.  S. Lindgren said we could paint the rails red and paint signs on the mooring poles as to where they are located.  S. Lindgren said the mooring poles are rusting and have rust blisters that will have to be addressed now, there is a liquid that turns rust into metal which will save them.  Commissioner Booth said go ahead and look into the cost and how to apply it, find out how many gallons will cover the 14 mooring poles.  Commissioner Booth asked B Osborne to provide a budget for maintenance services for 2021.  The port director will forward last years spreadsheet to B. Osborne for a comparison.

Port Maintenance Reports:

Hoodsport Trail Park & Disc Golf Park:  B Osborne said everything is going well, the 9 Tpads are finished and the course looks great.  Commissioner Brazil asked what is going on with the trail signs. B Osborne said we are waiting for the disc golf course to be complete, M Rothrock is in charge of that.

Hoodsport Marina, Dock & Waterfront Park: S Lindgren said someone is using the water pipe on the dock.  The port director said the water bill was higher than usual. S. Lindgren said someone removed the clamps to move the water line, the compression fitting gets pulled out and it leaks, he will glue it together.  Commissioner Brazil asked if there are meters on the water lines.  Commissioner Booth asked if we could put a pad lock on it so once the water is shut off they cant use it.  J. Morris said is has to be a leak, you need to fix the leak. S. Lindgren said the garbage will be picked up every other week starting in October for the winter months.

Port Directors Report

The Fall port newsletter was read and approved by the commission to be published on the port of hoodsport website and in the Lake Cushman newsletter.  A Facility Use Agreement between the Port of Hoodsport and YSS Dive Shop is being reviewed by the port’s attorney.  The application submitted to DNR was approved for the first step in the Hoodsport Trail Park forest management plan. The plan is to harvest trees identified to have root rot before they become hazardous and dangerous to the public.  J Morris asked if the port can take out trees that are diseased but still marketable.  The port director said yes, that is the plan to take them out while they are marketable and not to wait until they are considered hazardous danger trees.  The port acquired the Hoodsport Trail Park from the State of Washington in 2009 with a stipulation that all revenue created by the trail park would go back into the trail park.  Currently, bridges and trails require repair, revenue will go toward the cost to remove trees, repairs, maintaining the trail park and upgrading the disc golf park. The port commission will be reviewing and discussing a preliminary budget at the next regular port commission meeting.  The port director said it is hard to gauge whether there will be an increase in property taxes and the levy for the port district, in listening to some of the people in the community, some people’s property tax assessments have gone up and some of them have gone down.  Lori Kincannon said hers went up after her house was finished.

Due to the most recent Governors mandate, COVID-19 health and safety compliance signs are posted on all port properties for the public’s information and on the office window.  The Port of Hoodsport port commission continues using the ‘Zoom’ virtual chat room venue for regular port commission meetings during the COVID-19 pandemic, the public can request an invite to attend the meetings.  Meeting dates are posted on the port’s website, on Mason TV, in the WPPA newsletter and posted on the port office window. Currently, the public may email the port for an invitation to attend the regular port commission meeting.  The request must be received by 4pm the day prior to the scheduled meeting.

Public Communication:   J. Morris said Heidi at the Chamber did a survey.  Heidi posted an online survey regarding the importance of the public restrooms in Hoodsport.  The survey had over 250 responses showing 82% of the people who took the survey thought it was extremely important to have public restrooms, 11% thought it was somewhat important. H. McCutchen asked the port director if she could be the Host of the Zoom meeting so that she could share the survey statistics from her computer.  M. Purvis said it mirrors the survey run 10-12 years ago. Commissioner Brazil said he did not see the survey. G. Purvis said it was shared on the Visitors Center page and Lake Cushman community group page.  M. Purvis said we think the restrooms need to be fixed, it’s the right thing to do. They use our parking lot, park every which way then maybe 10% of the people come into the store. There were comments from people who came to the public restrooms and then to shop, the restrooms don’t’ draw people but welcomes customers to the community.  Commissioner Booth said we all think the town needs public restrooms, the question is who will pay for the repair, water, electricity, supplies and maintenance.  Who will take it over?  M Purvis said its obvious, the people who funded it.  We need a group to help fund $10.K per year which is what I see is the deficit. I see that as the missing component, we should be able to find that income. How do we open it, we need to open it.  Commissioner Petz said we are still under COVID-19 and asked the port director what the state requirements are for opening the public restrooms.  The port director said with the current drain field situation, the restrooms were open Friday through Monday.  Cleaning personnel should wear protective gear and wipe down high touch surfaces routinely, possibly every hour. H McCutchen said there are COVID related funds available.  Commissioner Booth asked H. McCutchen, are you using COVID funds for the Visitors Center?  H. McCutchen said no, we are not eligible. Government entities could have funding.  M Purvis said why don’t we raise the taxes if people want the public restrooms. J Morris said, how much does it cost, it should be free. Commissioner Booth said even if we raise the tax levy, since we have a very small tax base, it will not be enough money, how does the port recoup $56,000.  The port director said the port of hoodsport’s annual tax-based budget is $97,500.00, the scenario to pump the septic tank as needed, supplies, maintenance, electricity, insurance and now water will cost upwards of $56,000. per year which comes to 57% of the ports budget.  To install a new drain field is approximately $75,000 and will deplete the port’s reserve by 65%. The port director said the port needs to have constant long term continuous monetary commitments to run the public restrooms.  H. McCutchen said doesn’t the lease say if the drain field needs to be repaired, the port has to fix it? Why is that a problem, if the community wants it and the people said they want it, just do it. Commissioner Brazil said we looked at all the ways to replace the drain field initially, there were no feasible alternative left, then we looked at the budget, it does not pencil out. Commissioner Petz said we have a balanced budget and we are going to have budget issues, looking at the latest calculations the idea of continuously pumping, we are looking at spending way too much money, the numbers put together by the port director for the pump out scenario is not sustainable.   Going back to the taxes, taking the highest levy may not work, it may raise the budget 1-2%, we have never taken advantage of the highest levy, we may take a harder look at the numbers.  If we can get the public restrooms operable, maybe someone can take it over.  M Purvis said if the port and the store put in a drain field at the same time we can each pay for it.  Commissioner Petz said we could use the approach of putting in drain field laterals in between the current drain field.  M Purvis said no you can’t because I would have to shut down my store.  If you want to use the original drain field, it would not allow me to have a reserve for myself, I am suggesting to sit down and find solutions. M Purvis said we would like to work on how you plan to move forward with the drain field.  There is a second spot above the drain field and the third spot is the county property.  Commissioner Petz said the county property is not feasible because the 4 homeowners were not in favor and one of them has a well head that was well under the county setback limit.  The upper ground is not going to work because when we walked it with B. Sund the septic designer, he said there wasn’t enough soil and it would be an expensive treatment.  M Purvis said B Sunds schedule and my schedule are conflicting.  Commissioner Petz said maybe we could use a different designer; I will talk to Alex at the County to see if he will extend the emergency repair permit. M Purvis said we need to walk the area to understand correctly how we do this; we need to weigh out if in fact the port can or wants to do this.  If it’s a forced issue, it won’t work so who is the entity that could take it over.  Commissioner Petz said it comes back to Commissioner Brazil and Commissioner Booth, how do you feel about working with M Purvis to get a drain field and to stay in the public restroom business.  Commissioner Brazil said, we can take the highest levy, but I am not in favor of running an all-out campaign to raising property taxes.  If it will deplete our budget or reserves, I am not in favor. Commissioner Booth said I am not opposed to taking the highest levy, but it is probably not enough for the port to maintain the public restrooms.  The port recently spent $10,000. on small dock repairs, we are looking at grants to repair the dock which will require a match. I don’t think it is wise as commissioners to deplete what little we have as reserves to replace the drain field.  I think the government has some responsibility, WSDOT, the County or Chamber should take it over.  M Purvis said I agree, travelers use it much more than customers.  We need a business group to help with the money, raise the money and cooperate to receive it and have a way to direct it just for the public restrooms.  We could call it “Friends of the Hoodsport public restroom group”. Commissioner Petz asked the port director how the port could receive monetary gifts, she said the port could receive monetary gifts as long as they were slated for and to be used for a specific purpose. H McCutchen said maybe the port could get a LID local improvement district.  Commissioner Brazil said that is a good idea, I will look in to how it works.  M Purvis said don’t open it until we find a resolve for the drain field that doesn’t hamper my business.  As far as money goes anything we can do or put in we can help finance it, only if we can get an agreement and get a plan.  Commissioner Brazil asked H. McCutchen if she could help with grants or if her organization can help contribute.  She said she checked with the assessor for the current rate the port can raise its levy to, she said she would be happy to walk the drain field property with M Petz and M Purvis and happy to help however she can.  J Morris asked if the drain field can be installed on both the Purvis property and the county property. M Purvis said he thought there was enough room above the existing drain field.  We need to resolve this drain field problem before we get to the point to increase taxes.  H McCutchen said I am signing off. At 11:08 am the screen went blank because H. McCutchen did not relinquish being the Host before she signed off.  The port director tried contacting her to no avail.  The port director finally created a new port meeting room at 11:30am and re invited the port commission back to the regular port commission meeting.

Commissioner Reports:  Commissioner Brazil said he walked the 9-hole disc golf course and it is very nice, he went across the street to the original disc golf course and could not find the basket to hole #1. When he spoke to B Grondin told him he was not in charge of the 18-hole disc golf course side, M. Rothrock is in charge.  Commissioner Brazil said the course is way overgrown and needs to be maintained.  The port director said she authorized concrete to be delivered at M. Rothrocks direction for the new pads on the 9-hole disc golf course side.  Commissioner Booth said Marine Floats will be completing the float repairs underneath the dock today.  Two ladders were ordered and will be delivered when they come to finish the job so there is not an extra trip charge. B. Osborne said he would install the ladders.

Public Restrooms: Currently closed to the public for health and safety of the public and personnel due to the COVID-19 pandemic. Portable restrooms with hand washing stations are available for the publics use provided by the Port and the Purvis’. Portable restrooms are serviced Monday, Wednesday, and Fridays and pumped additionally when needed. Maintenance personnel monitors garbage and supplies additional toilet paper as needed.

Port parking/Office building/Maintenance shed: B. Osborne and S. Lindgren have Security App’s on their phones to monitor live stream surveillance cameras overlooking the public restrooms, office building, shed, parking lot, waterfront park and the dock.

Port Directors Report

Commissioners need to turn in their 3rd ¼ per diem timesheets by the end of September.  A Facility Use Agreement between the Port of Hoodsport and YSS Dive Shop will be reviewed by the port’s attorney.  An application was submitted to DNR for the first step in approval submitted by Ben Carlsen, forester hired to manage the Hoodsport Trail park trees. The plan is to harvest trees identified to have root rot before they become hazardous and dangerous to the public.  Governor Inslee extended the OPMA guideline to August 1,2020, Mason County opened the county up to Phase III which allows people to gather in groups of 50 or less, wear face masks, and social distance six feet away. Commissioner Reports:  Commissioner Booth wished Commissioner Brazil a Happy Birthday.  Commissioner Booth said a final bill has not yet been received from Marine Floats who did some repairs on the ports dock, she is still waiting for a scope of repairs on the floats which will be in Phase II of repairs, quoted at $4500.00.  The port was quoted $430.00 to replace two 3 step swim ladders to be attached the dock, the price does not include installation.  B. Osborne said he could install them with no problem.  Commissioner Booth said in submitting a grant application for the dock, the port will have to amend the ports 45 page ‘master plan’.  Commissioner Petz asked if the port was applying for a repair or replacement of the dock?  Commissioner Booth said we are applying for a repair; we do not have matching funds for a replacement. Commissioner Petz said the amendment could include the completed projects since the last amendment, such as the purchase and installation of the public restrooms for the community and now is in transition to off load it to the business community.  The port is in the beginning of its study on replacement of the existing dock and pier, as far as buying land for incubator businesses, the port looked at several properties which did not fit the criteria. Commissioner Booth said we are on a time sensitive timeline to have the amendment by next week.  Commissioner Petz said since you require an amendment to be done immediately to support your grant application, keep it simple and focus on the dock, just make the amendment to that section for now.  You should also address acquiring funds for a design and replacement of the dock by making it a three-part request. 1) Immediate repairs for the dock 2) Design of the replacement of the dock 3) a Grant to replace the dock.  Commissioner Petz motioned to make necessary amendments to the ‘master plan’ as discussed, Commissioner Brazil seconded, motion carried.

Public Communication: J Morris asked where the port is on the public restrooms.  Commissioner Petz said a budget scenario was done, it totaled out the cost for an approach to open the public restrooms without a new drain field and to pump the septic system, as necessary. With maintenance, supplies, electricity and pumping, the approach will cost $53,600. Commissioner Petz said the Purvis’ are generously paying for the water.   To pump the septic tank as necessary will cost $22,000.00 annually in which M. Purvis said he would pay for ½ of the cost to pump the system for one year only.  The second approach would be to close the public restrooms and rent portable restrooms for the public, which would cost $15,000.00 annually.  The third approach is to repair the septic drain field at a cost of $60-$75,000 from the port’s reserves depleting it by 64% then having an annual cost of to maintain and supply it at $35,660.00.  J Morris said the Mason County reports from last weekend said there was trash and feces along the side of the road going up to Staircase park.  The forest service did not replace outhouses at the park at Staircase, the forest service closed Staircase and trails to the public. Mt. Rose, Mt. Elinor and all trails are closed to the public. Commissioner Brazil said there was a drowning, a shooting, fights, drunk people, trash, traffic was backed up from Hwy 101 all the way up State Rt 119 to the party rock. Mason County Sheriffs could not even get to the party rock by the entrance to Staircase park when they were called. Currently, the park service closed Lake Cushman Rd. State Rt 119, Lake Cushman, Staircase park, Forest Service Road 24 until September 30th. J. Morris said closing all the trails will affect all the businesses in town, business has been super good, we were jammed, when they closed the roads, we lost 1/3 of our business. Commissioner Booth asked J. Morris if the Chamber talked about putting more portable restrooms at the Visitors Center.  Jan said we talked about the public restrooms in Shelton and in Hoodsport and Heidi from the Mason Chamber wrote a letter on behalf of the community from the Chamber to the Port of Hoodsport, you should get it soon.  J. Morris said we have encountered conflicts between business owners due to the lack of public restrooms.   Commissioner Brazil asked if the Chamber supports the public restrooms in Shelton, J. Morris said the Chambers priority is to run their town, it supports the Visitors Center in Hoodsport with volunteers who provide material and are engaged in the community.  The businesses in Hoodsport could run the Visitors center, we could make our own Chamber if more people were more involved like me.  I don’t see any other businesses getting involved.  We may get more collaborative business owners in the future but for now, I don’t see it. The Chamber has not set rules of accessibility for the Visitors Center, they get money from the L Tax and whoever does the funding is the entity who set the hours for the use of the outhouses.  Commissioner Booth said the only public restroom option is another portable restroom for a short term.  J. Morris said long term portable restrooms are not ideal. Commissioner Petz said what gets used the most, the dock gets used somewhat, the people who benefit from the dock are fisherman, residents of Hoodsport don’t use the dock, people use the disc golf course and the public restroom gets used.  Commissioner Petz said the design window for a back up drain field expires in October. Is there any interest in taking a legal approach in taking measures to move forward?  J. Morris said just go in and start the work, show cause why you should not do it legally if you have the right to do it just go forward and do it. Commissioner Petz said the port has the authority to do the repair, identify where the reserve field is specified. My feeling is to take a step to challenge the drain field.  Commissioner Brazil said I don’t agree with challenging it, not to mention our budget does not support the cost of a drain field, maintenance, and supplies for the public restrooms.  No one else wants to take over the public restrooms or help.  We cannot maintain the current cost of maintenance and supplies.  J. Morris said are you against it? Are you against the public restrooms?  Commissioner Brazil said No, I agree the town needs a public restroom, I am saying the Port can no longer foot the bill.  If you look at our budget, it is not a good plan. J. Morris said other ports have public restrooms, what is your vision.  Commissioner Brazil said other ports have more money, Shelton has eight port districts, with lots of tax payers in their district and they have big budgets, we do not, we have a tiny budget of $97,940.00 and when we are lucky, we get other revenue to help.  J Morris said I am so frustrated about the public restrooms. No one wants to take it over, I talked to Sharon Trask to possibly get involved to help with pumping. L tax has some money, we could invite her to talk about methods for additional help for more sources.  Commissioner Brazil asked the director to gather competitive bids to find out if the cost of pumping the drain field is negotiable.  J. Morris said if we incorporate Hoodsport and make it a City, we can take the public restrooms off the ports table.  Commissioner Petz said let’s move on to disc golf.  Commissioner Brazil spoke to M Rothrock and B Grondin about T-pads at the disc golf course.  It looks like cement pads are the pads of choice, so the players don’t slip when they throw the disc.  Commissioner Brazil said the director emailed the Memorandum of Understanding to M. Rothrock for online electronic signatures of the new disc golf board members.  The director said she has not heard back from M. Rothrock and will follow up again.

Public Communication:   The Port director introduced K Yackel as one of the owners of the new YSS Dive shop next to the waterfront park. We had a phone conversation regarding the YSS Dive shop entering into a Facility Use Agreement to use the ports waterfront park for staging and entering the canal with their dive students. The port discussed usage at the last port commission meeting and was in favor of the dive shop using the are if they were mindful of families and the public using picnic tables and the grass area.   YSS Dive shop agreed to enter a FUA with the Port and will list the Port as additionally insured on their liability insurance with coverage no less than $1,000,000. per occurrence.  The Facility Use agreement will be reviewed by the Ports insurance company and attorney as well as the Yackel’s attorney.  K. Yackel asked if the Port commission would be interested in the having the dive area around the dock be adopted as a Dive sight?  They are involved in ‘Project Aware’, an ocean conservation program whereby the Dive shop adopts a dive site and has conservation classes there.  The site is posted online and seen worldwide as an adopted and protected dive site.  Divers will be diving around the ports dock; all dive debris is reported and documented. 100 % of the funds from every dive certification for PADI and SIO goes toward conservation.  So far they have discovered 5 sunken boats under and around the port dock, there is also a car barge that sunk over 50 years ago at a depth of 60’ and there is a tire reef.  Students are taught how to look at dive wrecks, we have seen 3 giant octopus, wolf eels and sea whips at a depth of 60’, they are a type of coral that only grows in the Hood Canal.  The minimum age of students is 12 years old.  We are the only dive store in Washington state that can dive right outside its shop. Commissioner Brazil said the dive shop provides a great service and are a real asset to our town.  Commissioner Booth said she wanted them to be aware of concerns of safety for divers during fishing season between July and November.  There are boats moving extremely fast pulling nets, there are people crabbing off the dock as well.  She emphasized they need to be extremely careful as most people will not recognize divers under the water around the dock even with a dive flag in the water.  K. Yackel said she is a master instructor certified in safety, they emphasize safety and have a shore support person for extra safety. Commisisoner Petz asked what do we have to do to be adopted as a dive site?  K Yackel said she will have to register it online and asked if the commission had a specific name, they would like to call it, the commission all agreed the Port of Hoodsport Dive site would be a great name.  Commissioner Petz thanked K. Yackel and said what they are doing is remarkably interesting.  M. Rothrock was present to talk about expansion of the 9-hole disc golf course, the club wants to move forward with finishing the 9-hole disc golf course and have been struggling with the COVID-19 rules and regulations, they are discussing how to proceed with safety protocols.  The port director said COVID-19 signs are posted in several areas at the disc golf course as per statewide prevention guidelines and they can monitor themselves. Commissioner Brazil asked if the new board of trustees had their paperwork together yet and if they have discussed signing the Memorandum of Understanding between the Port of Hoodsport and the new board members of the Disc Golf Association.  M. Rothrock asked the port director to email the MOU, he could then create a format for online signatures that would work for everyone. M. Rothrock said they are ready to put in the pads which entails coordination of people, concrete forms and a concrete truck delivery. Commissioner Petz said get it scheduled before the weather window disappears.   M Rothrock said it will be in early September.

Commissioner Reports:  Commissioner Booth and the port director had a Zoom conference with Commissioner K. Shutty and K. Leaf from the Economic Development Council to talk about further funding to defray costs associated with the public restrooms as far as pumping septic tanks, maintaining and supplying them.   They also discussed how they might help with matching funds for a grant to replace the ports dock.  Commissioner Shutty suggested tapping into the Lodging tax however it is not guaranteed year to year.  Commissioner Booth said, in looking at the City of Shelton website on the L-Tax, it said the L-Tax decreased this year due to COVID-19, people are not staying in hotels and they have cut their staff by 50%. We missed the cut off date for next year’s RCO grants in the boating infrastructure category.  We need to discuss ports funds regarding having enough money to match a percentage of grant money.  One of the things the Port needs to do is update the ‘Master Plan’. The port director will email a copy of the ports ‘Master Plan’ to each commissioner for review and input.  The port director asked the commission to review the Public restroom budget scenarios which breaks down costs and percentage of the ports budget for each scenario 1) pump the septic tanks on an as needed basis as suggested in past meetings would cost 55% of the ports annual budget 2) rent portable restrooms in lieu of pumping would cost 15% of the ports annual budget 3) replacing the drain field, normal hours, pumping during high season would cost 65% of the ports reserve and 36% of the ports annual budget. Commissioner Petz said the Port’s budget cannot sustain the pumping scenario even if the constituents were polled with a survey on whether they wanted to continue with the public restrooms.  Without guaranteed consistent additional funding, the ports budget cant sustain the cost.  Commissioner Brazil said if the port provided portable restrooms it would only cost 15% of the ports budget.  Commissioner Petz said if we are getting out of the restroom business, we do not need to supply portable restrooms.  Commissioner Brazil said during shrimping and in the summer months, it may be beneficial to put a couple of portable restrooms on port property by the ports shed so people using the dock can use them.  Commissioner Booth said we need to figure out what dock repairs need to be done. Once we know, can the port afford a 25% match, still a qualifier is that no more than 10% of the match can come from Government sources and hopefully we have the 15% in our reserves.

Port Maintenance Reports:

Hoodsport Trail Park & Disc Golf Park:  B. Osborne said other than the normal maintenance there is nothing more to report.  He will help B. Grondin get the forms made to pour concrete for the pads and find out the price on concrete.

Hoodsport Marina, Dock & Waterfront Park: B. Osborne said one flotation came out from under the middle slip on the dock.  Both ladders have been broken off the dock, if someone fell in the water, they would have a hard time climbing out.  Commissioner Brazil made a motion to purchase two aluminum ladders to be replaced, Commissioners Booth and Petz agreed, it was unanimous.  B. Osborne said he would check with Marine Floats for recommendations and get a price for the port administrator.

Public Restrooms: Currently closed to the public for health and safety of the public and personnel due to the COVID-19 pandemic. Portable restrooms with hand washing stations are available for the publics use provided by the Port and the Purvis’. The company who services the portable restrooms are cleaning them Monday, Wednesday, and Fridays. The director is calling with extra service to the portable restrooms when needed. The Port personnel are checking garbage and supplying additional toilet paper daily.

Port parking/Office building/Maintenance shed: B. Osborne and S. Lindgren have Security App’s on their phones and are monitoring the live stream surveillance cameras that oversee the public restrooms, office building, shed, parking lot, waterfront park and the dock.

Port Directors Report    The port director spoke to the director of the Port of Shelton to find out about polling the public, she said it was awfully expensive to mail surveys and they opted to have two public meetings instead.  The port director said at this point with COVID-19, we could only send out a survey or an online survey to the port’s taxpayers.  The port director will call Mason county to obtain a list of taxpayers in the ports district.  The port director will send a Facility Use agreement to the port’s insurance company and attorney for review before obtaining signatures from YSS Dive shop.    The port is writing an adapting, evolving policy to meet evolving port policy requirements as per the Governors guidelines around ports and COVID-19.  Governor Inslee extended the OPMA guideline to August 1,2020, Mason County opened the county up to Phase III which allows people to gather in groups of 50 or less, wear face masks, and social distance six feet away. Due to the most recent Governors mandate, COVID-19 health and safety compliance signs are posted on all port properties for the public’s information and on the office window.  The Port of Hoodsport port commission continues using the ‘Zoom’ virtual chat room venue for regular port commission meetings during the COVID-19 pandemic, the public can request an invite to attend the meetings.  Meeting dates are posted on the port’s website, on Mason TV, in the WPPA newsletter and posted on the port office window. Currently, the public may email the port for an invitation to attend the regular port commission meeting.  The request must be received by 4pm the day prior to the scheduled meeting.

Public Communication:  Commissioner Petz asked the port’s director to recap the entire public restroom situation ending with the cost to the Port’s budget.  The director went over the timeline from the beginning of the failed septic system in 2018, steps taken to identify the problem, exploration of all of the available avenues to remedy the situation and the analysis to maintain and supply the public restrooms. The operational cost to supply and maintain the public restrooms cost up to 31% of the ports budget and installation of a new drain field would cost the port 28% of its reserve. M. Purvis said it was sad that we failed to find a solution. He suggested analyzing the cost to pump the septic tank every time it gets full instead of spending money for the cost of a new drain field.  He said the port will need to find a way to operate it or remove it. M Purvis did an analysis of the cars in the parking area by the public restrooms and found 10% of the people using the public restrooms use their store, 90% of the people go to the others stores, are hikers, boaters & travelers.  He said the Hoodsport businesses and WSDOT should be sharing the cost.  He feels public restrooms are needed in every town and named several towns in the state who have them.  He suggested if the community business owners were not willing to step up to help with the cost, the port could campaign for a Levy to raise taxes to help pay for the public restrooms especially since when the public was polled in 2007, public restrooms were the number one item the community wanted.  The people wanted the public restrooms, it was unanimous, maybe they will pay a higher tax to keep it in Hoodsport.  This makes Hoodsport a real town. Other business owners think the public restrooms were built for IGA. We donated the land for the public restrooms, septic system and drain field, we also pay for the water.

We need a certain standard; the restrooms need to be clean and nice or not at all.  M. Purvis said if the County approved using the existing drain field and the effluent could be monitored so it was pumped when the tank was full, it could work.  Just put a meter on the tank and have the pumper pump it into the drain field when its full, pumping more often with regularity and possibly once per week for 12 summer weeks may be a better plan. IGA would be willing to pay for 50% of the cost to pump the septic tank for only one year for the cost of pumping only.  Commissioner Brazil said before COVID-19, the public restrooms were open Friday-Monday as per the County’s guidelines since the drain field failed. The restrooms are now closed to the public to prevent the spread of the virus to the public and port personnel.  We have had portable restrooms with hand washing stations since March 2020.  M. Purvis said, we are not trying to hurry or push the issue and don’t want to rush it.  Commissioner Petz said he will get B. Sund to check with the County to make sure they would approve if we downsize by cutting back the 2 drain field laterals, set the distribution to only 8 laterals then monitor the effluent and how much is going in to the drain field.  M. Purvis said it is hard to work within B. Sund’s time frames with any kind of installation of a new drain field.  Commissioner Petz said with everyone the port consulted with to identify the problem, it was B. Sund who did, and he has good communication with the County.  B. Sund renewed his license strictly to help the port in this situation. J. Morris from the Hardware Distillery said she would contribute $1-$3000. Per year and will ask other business owners to contribute. She said she would do whatever it takes to help get a tax increase levy passed.  Commissioner Petz said the Port has not increased the Levy for 10 years and could take the highest levy for the 2021 budget without a vote.  M. Purvis said the broader we can spread the cost, the less one person has to pay, until COVID simmers down, we have time to do homework.  Jan said most ports keep their public restrooms open.  Commissioner Booth said other ports have a big budget and the staff.  Commissioner Brazil said those other ports are enormous with big budgets. Jan said she can start fund raising.  M. Purvis said the Port of Hoodsport is the cheapest tax district. Commissioner Brazil said our dock needs attention. Commissioner Booth said our gangway has collapsed down and we are missing a float among other things that will continue to go wrong with the dock. M. Purvis said if you take out the docks and the public restrooms, people will miss them.  Commissioner Petz said he would contact the County and B. Sund to find out if we can operate as discussed. M. Purvis said he appreciates everything and would like to communicate as often as possible. B Grondin said the Shelton Disc Golf club had its meeting on July 6th at the Shelton disc golf course. Commissioner Brazil said he tried to attend but could not find the disc golf course in Shelton. B. Grondin said it is by the cemetery and the next meeting is scheduled for August 3rd.  He said it will be one year since the Hoodsport Hills Birdie Bash grand opening.  Commissioner Brazil said he would like to see them do something for the annual anniversary of the opening to generate publicity and promote the disc golf course, you can encourage people to come out with flyers and have free hot dogs.  B. Grondin said we plan to have a tournament on August 8th, we could have a pay to play $10. 00 to enter with an 18-hole payout.  Entry fee could be for one round, members get 50% off.  COVID-19 slowed things down a lot.  He would like to have a nighttime glow disc tournament and have an event at the same time every year.  B. Grondin said the club is talking about lengthening 4 holes at the birdie bash and get players opinions to evaluate the difficulty.  Commissioner Brazil said in regular golf there are red, white and blue holes to accommodate different technical levels of golfers, you can play three different ways with two pad placements for each hole. B. Grondin said after the tournament in August, we will have a good feeling about where to place the pads. After Labor Day, we will need fill dirt, bed sand and wood for the bases to set the composite pads.  Commissioner Brazil asked if they have disc golf score cards, B. Grondin said we have score cards during tournament’s but not when we go out to play, we use plastic score cards that can be erased.  B. Osborne said he would build a Kiosk before the tournament.  B. Grondin said Josh will run the tournament and he will ask Morgan if he can make a map of the course.  B. Grondin said he would like to invite the Commissioners up to the course on August 8th for the Birdie Bash from 8am-5pm.  Commissioner Brazil said he would be there.

Commissioner Reports:  Commissioner Booth met with Jack Inslee of Marina Floats regarding emergency repair on the dock to the gangway and the end finger of the dock which appears to be missing a float.  She said Marine Floats is on the MRSC roster and bid came out to $5000.00 for materials, permits and labor.  She let Jack know that the public dock will be extremely busy during shrimping days and gave him those dates of July 15th and July 28th to avoid working on the docks.

Hoodsport Trail Park & Disc Golf Park:  S. Lindgren said he is clearing hiking trails as needed. The disc golf course and parking area is looking great, people are playing a lot of disc golf.

Hoodsport Marina, Dock & Waterfront Park: S. Lindgren said lots of people are using the dock and the waterfront park. Hundreds of snails are still eating the flowers in the planters, despite using snail bait.  Over the 4th of July weekend, there were people everywhere setting off fireworks, despite the Ports signs that say, ‘No Fireworks’. He picked up the discharged fireworks trash, it filled the dumpster. Lots of garbage is being left by people, shrimp days are the worst, shrimp heads and smelly cat food is in and around the garbage cans.  The marina slips have been full during shrimping, future shrimping dates are July 15th & 28th. The Welcome to Hoodsport sign blew off the dock in a big wind, it was retrieved and will be fixed.

Port Directors Report   The port director presented the Commission with Resolution 2020-02 stating the Port of  Hoodsport has established the Remote Meeting Procedures and arranged for remote attendance by the public at those meetings.  the Port of Hoodsport has all of its commission and one third of its contracted personnel in the high-risk category. The Port of Hoodsport’s conference area in their office space is the dimension of 10 feet by 20 feet making it impossible to social distance at least 6 feet. The Port of Hoodsport desires to continue conducting meetings that are subject to RCW 42.30 during the COVID-19 outbreak in a manner that allows for public participation with the fewest restrictions. The Port of Hoodsport restates, ratifies and extends the Remote Meeting Procedures it has established under Proclamation 20-28 regarding remote attendance for meetings subject to RCW 42.30, the Open Public Meetings Act until it is safe to return to the limited office space and can continue keeping the health and safety of the commission and contracted personnel. The port director will attend the annual port director’s seminar hosted by the Washington Public Ports Assn. on Thursday July 9th via an online meeting venue.  The Port director will be writing port policy once the WPPA has verbiage available for ports to create an adaptive evolving work policy as COVID-19 evolves and we continue to receive guidelines and mandates from the Governor.  An email was sent to Lori, the president of the Mason County golf association to discuss current officers, board members, a memorandum of understanding and expectations. Public Communication:  J.Morris said she contacted the chamber for possible funding on septic grants and invited H. McCutchen to share their resources. H. McCutchen said she knew of septic vaults that failed at Steamboat Island and had some possible solutions. Commissioner Petz said the history of the  public restroom septic system failure started in 2018, water surfaced in two drain field laterals because of overwhelming usage that exceeded the capacity of the design of the system and depth of two end laterals. The laterals were placed too deep on compacted soil with no drainage, the port evaluated a couple of approaches, dig another drain field in the reserve area or use adjacent property owned by the County. Neighboring owners of the County property were not in favor because there are water wells within a 100’ radius and other issues.  There is a reserve drain field area designated for a back up drain field but the property owner is reserving the right to use it for their future expansion.  The only current option was a suggestion from them, they proposed using the existing drain field to its capacity, monitoring the septic tanks and use periodic pumping the of the tanks as needed which could be weekly or more in the summer months (twice a week or more during major holidays and high traffic times) then bi monthly or more as needed in the winter months.  The septic tank is 2000 gallons and it may cost up to $600. per pump. May – September, 5 summer months times 4 or 5 pumps per month or 20-25 times, October-April 7 winter months times 2+ pumps or 14-20 times on top of maintenance, supplies, electricity, and insurance.  IGA currently pays the for the water. H. McCutchen asked if there was clear access to the tanks. Commissioner Petz said there are covers that are designed to take the weight of a vehicle, there are no access problems unless people are parking on top of them. H. McCutchen said she would like to see if she can get more information on a septic solution acceptable to all parties, with COVID-19, I hate to see closure of the public restrooms burden other business owners. Commissioner Petz said the port has rented portable restrooms with hand washing stations for the publics use.  The public restrooms support all businesses in downtown Hoodsport and travelers. IGA’s view is that 10% of the people using the public restrooms use their store, the other people shop at other businesses, are boaters, hikers and travelers.  H. McCutchen said she could find a college student who could count how many people who use the public restrooms and shop in town. She said she would like to poke around to find solutions.  Commissioner Petz said the Port has other things it is responsible for and has concluded the public restrooms do not make financial sense, we do not want to be in the public restroom business, we have a balance budget and pumping it will break the budget.  We know it is needed, would like to keep it alive and would like to see another entity or the community take it over.  We can surplus it to an entity, we have tried to get WSDOT, the County and the Chamber to take it over. The property owner does not want it either, they would rather have it removed from their property.  H. McCutchen said if there is no solution, she is not sure that anyone would want it.  She said if it were functioning as it should be, would the Port want to get out of the business?  Commissioner Petz said, Yes, we want out of the business, we cannot sustain it financially. Commissioner Brazil said 35% of the budget goes to the public restrooms, we must find a way to let someone else take over, we cannot maintain it, raising taxes will not do it.  We were naïve when we did an analysis of how many people would be using the public restrooms and over the years more and more people are coming to Hoodsport and traveling on Highway 101.  WSDOT would be the sensible entity to take it over.   J. Morris said the business pulse is that everyone wants the public restrooms because we are only business self sufficient with public restrooms, we get overflow, it is critical to our businesses. H McCutchen said the port should raise their taxes, the business owners are hard hit with COVID and shouldn’t have to pay for the restrooms, everybody should contribute.  If you tell residents the town needs the public restrooms to support the business community and they feel raising the tax rate benefits them, they will support it. You should increase the tax levy.  Commissioner Petz said we have purposely not increased the tax levy since 2010, I guess we could take the highest levy available without a vote.   Commissioner Petz said we are operating under emergency repair and the authorized emergency permit will expire in October 2020.  J Morris said she could ask several of the business owners if they are willing to pump the system one time per year and maybe they are willing to pay the pumper directly.  Commissioner Booth asked if H. McCutchen was familiar with a pumper who could pump at a better rate.  H. McCutchen said they use a specific company who takes care of the portable restrooms at the visitors’ center. Commissioner Petz said he was in contact with B. Sund who will talk to A. Payse at Environmental health to find out if it is even an option to use the existing drain field with the 7 laterals as is and monitor and pump it. J. Morris said she would like to help Commissioner Booth in writing a grant for the docks.

Lindgren said they have another couple of days to finish the job, maybe longer.  Commissioner Booth said the final day of shrimping was called off.  Commissioner Petz said he was working with the state to relax restrictions on shellfish harvesting in Hoodsport.  The Public restrooms was on the list of concerns.

We put in 3 loads of fill by the gazebo which makes it easier to mow.  We will be moving pads after August, there are 9 pads in storage, and we will use those first.   B. Grondin took down the sign on the other side and re installed it on the 9-hole side.  He put in pilons, moved rocks around, put up a fence around the picnic table to protect people for discs and is making progress.  Commissioner Petz said we will eventually want to get the expert course usable.  We need to get the Memorandum of Understanding firmed up with the disc golf club.  The port director said she has emailed the president with detailed information on what the Port needs from them, with no response.  Commissioner Brazil said he was going to the next disc golf club meeting and would like all the information from the email so he will know what to ask.

Hoodsport Marina, Dock & Waterfront Park: S. Lindgren said lots of people are using the dock and the waterfront park. The divers from next door are using a table at the waterfront park for their students but are not blocking other tables that are used by the public, they go down the steps and swim in the shallows.  Commissioner Petz said they need to be sensitive to the public families using the park and asked the director to contact the insurance company to talk about liability and discuss it with the dive shop.

Port Directors Report     The port director consulted with the ports attorney, there is a way to take donations to assist with restroom costs if money is specifically slated and used properly.  There is also a way to help the community with specific needs such as supplies or pumping of the public restroom but was advised to stay away from binding contracts.  The port is writing an adapting, evolving policy to meet evolving port policy requirements as per the Governors guidelines around ports and COVID-19.  Governor Inslee extended the OPMA guideline to August 1,2020, Mason County opened the county up to Phase III which allows people to gather in groups of 50 or less, wear face masks, and social distance six feet away. Due to the most recent Governors mandate, COVID-19 health and safety compliance signs are posted on all port properties for the public’s information and on the office window.  The Port of Hoodsport port commission continues using the ‘Zoom’ virtual chat room venue for regular port commission meetings during the COVID-19 pandemic, the public can request an invite to attend the meetings.  Meeting dates are posted on the port’s website, on Mason TV, in the WPPA newsletter and posted on the port office window. Currently, the public may email the port for an invitation to attend the regular port commission meeting.  The request must be received by 4pm the day prior to the scheduled meeting.

MINUTES FROM THE VIRTUAL REGULAR PORT COMMISSION MEETING OF THE PORT OF HOODSPORT COMMISSION                   June 24, 2020

Approval of Agenda:  Commissioner Brazil made a motion to approve the agenda as   written; Commissioner Booth seconded; unanimously approved.

Minutes: Commissioner Brazil made a motion to approve the virtual regular port commission minutes from June 10, 2020, Commissioner Booth seconded, unanimously approved.

Vouchers:   The following Vouchers/Warrants were approved for payment: June 24, 2020 in the amount of $7,364.70

Public Communication:   B. Grondin said the disc course and parking area is looking good, we solved the mud problem, put in a practice basket and cleaned up the logs on the course.  A guy from the Disc Golf National Review showed up while I was there, we played a 9-hole round, he ranked it high, said it was fun and he liked it.  Commissioner Petz asked if he played the 60-acre side of the highway, B. Grondin said it was overgrown. S. Lindgren said it was impossible to follow.  Commissioner Brazil, we have money tied up in equipment on that side, what are we going to do with it?  B. Grondin said he could ask the Disc Golf association players at their next meeting.  They would like to build another 9-hole course on the 20-acre level side and could reuse the composite T pads and basket equipment.  The players talked about lengthening a few of the holes after playing them more.  Commissioner Brazil said let’s get a plan together and figure out where to start.  S. Lindgren said he would start disassembling the composite pads.  Commissioner Petz said our original plan for the 60 acres was to put in a premier course for expert players to contribute to the welfare of the community, I would like you to find out what we are doing with the challenge course, not sure we want to abandon it.  Commissioner Brazil asked when will the next Shelton Disc Golf Assn. be meeting, I would be happy to attend. B Grondin said it was the first Monday of the month, the next one will be on July 6th at 6pm at the Shelton Springs disc golf course.  B. Osborne said there were 6-8 cars in the disc golf parking area in the last two days.  B. Grondin said the Cushman Cruise course is rated 4.5 out of 5 and people are coming from all over the state to play. Commissioner Petz asked how the Shelton Springs course ranked, B. Grondin said it has been ranked the number 1 course in the state for the past 11 years straight.  Commissioner Brazil asked if they were going to host any tournaments, B. Grondin said Josh was working on that.  Commissioner Brazil asked how they keep score and suggested course cards be printed up with the layout which may raise it up to a pro level.  B. Grondin invited the port commission to walk the disc golf course and said he would like to have an annual event of an 8-12-week doubles or singles events.

Commissioner Reports:  Commissioner Petz said he has not had success in discussion about the public restroom septic with the Purvis’.  The port director said the Purvis’ asked to attend the next regular port commission meeting, a Zoom invitation was sent to them to attend the meeting, there was no response.  Commissioner Petz asked the Port director to go over the timeline from the beginning of discovery of the failing drain field with the Port commission.  The Purvis’ have been very generous with good will, kindness and cooperation to the Port, its constituents, the public, surrounding business owners and neighboring citizens regarding the public restrooms. In 2018 due to overwhelming usage of the public restrooms that exceeded the design and capacity of the septic system, the original drain field could not meet the demand, the pubic restrooms were utilized to the point that the septic drain field began to fail.  Mason County environmental health department issued notice that the Port must cease and desist full capacity usage of the public restrooms and find a solution to resolve the matter. Steps were taken to identify and resolve the issue with the original septic designer and installer, septic companies, septic pump manufacturers, other septic design experts and Mason County were all consulted. It was determined that an additional drain field was needed, an emergency drain field repair permit was issued by Mason County. The County put conditions and restrictions on usage of the public restrooms to monitor gallonage daily and reduce public use, it was agreed by the Port and property owner to provide an alternative to the situation by renting regular and ADA portable restrooms to compensate. The Port is again, very appreciative of the Purvis’ generosity, cooperation and assistance in this additional effort.  In June 2019, the port was notified by the property owner to consider using an area above the drain field or to look at another property close by owned by Mason County for the alternative drain field.  The septic designer determined the soil was not feasible on the upper property and it would require a very expensive treatment.  The Mason County property was deemed not feasible due to several factors to include well head setbacks, soil suitability and neighboring owners who were not in favor.  The Port received another document from the property owner which was a lease amendment to resolve septic issues.  In reviewing the options, option #1 was not feasible because the port cannot build three separate drain fields and it is cost prohibitive.  #2 if the ports drain field and a second drain field were built simultaneously, another septic design will have to be submitted for approval and permitting which would extend the installation time window into 2021.  As for the burden of the cost to maintain and supply the public restrooms, a cost analysis was done of the cost to maintain, supply restrooms in high season in a full operational year, with summer months and days of usage exceeding the septic tank limits per day, additional pump outs and portable restrooms. Annually it costs up to 31% of the ports budget.  To install an additional drain field will deplete the port’s reserve account by at least 28%.  Other factors include unknown future revenue delays due to the COVID-19 extension of property tax payments.  The port explored options with WSDOT, the Chamber of Commerce and Mason County to take over or assist with the burden of the public restroom to no avail.  Due to COVID-19, a scheduled meeting and collaboration with higher levels of government for assistance is no longer viable.   Commissioner Brazil said we need to have a public meeting to discuss this with the property owner to go over those points and can come to a decision.  Commissioner Booth said she agrees, we need to sit down and discuss how far we have come and the best direction for the port and everyone involved.

Port Maintenance Reports:

Hoodsport Trail Park & Disc Golf Park:  S. Lindgren said he is clearing hiking trails as needed. The disc golf course and parking area is looking great, people are playing a lot of disc golf.

Hoodsport Marina, Dock & Waterfront Park: S. Lindgren said lots of people are using the dock and the waterfront park. Hundreds of snails have been eating the flowers in the planters, we used snail bait, but they aren’t going away.  Lots of garbage is being left by people, shrimp days are the worst, shrimp heads and smelly cat food is in and around the garbage cans.  The marina slips have been full during shrimping, future shrimping dates are June 26th, 28th, July 15th & 28th. ‘No Fireworks’ signs are posted along the sidewalk by the beach.  S. Lindgren said another ‘dog’ area  will be created by the shed since people like to take their dogs over there.

Public Restrooms: Currently closed to the public for health and safety reasons due to COVID-19 pandemic. Portable restrooms with hand washing stations are available for the public provided by the Port and the Purvis’.  The company providing the portable restrooms will be servicing them daily during the 4th of July weekend.

The port commissioners time sheets for the second quarter are due, they can be emailed or left on the conference table before Friday.  An email was sent to Lori, the president of the Mason County Disc Golf Assn to gather information at the next disc golf meeting so we can proceed with a Memorandum of Understanding between the Port of Hoodsport and the MCDG Assn.  I will be attending a round table meeting with the Washington public ports association on Tuesday June 30th, we will be discussing returning to the office after July 1st.   The Governor extended the OPMA guideline to July 1st, and Mason County opened the county up to Phase III which allows people to gather in groups of 50 or less, wear face masks, and social distance six feet away. Currently, the public may email comments to the ports email address to include in the minutes but may not participate in the meetings. A Resolution was drafted authorizing the executive administrator to act in making decisions in an emergency situation, closure of the public restrooms for the safety of the public and maintenance personnel to holding regular port commission meetings online via Zoom as per the Governors guidelines for the OPMA were the changes that have been made during the COVID-19 pandemic.

Port Maintenance Reports:

Hoodsport Trail Park & Disc Golf Park:  S. Lindgren is clearing hiking trails as needed. We are waiting for the parking lot to be redressed, there is a big wet spot where the portable restrooms are currently located, and the septic guy is having trouble accessing the portable restroom to clean it, the restrooms may need to be moved to another spot. Hoodsport Hills course warden maintains the 9-hole golf course and is opening/closing the chain barrier during the day for disc golfers.

Hoodsport Marina, Dock & Waterfront Park: S. Lindgren said lots of people are using the dock and the waterfront park. Snails have been eating the flowers in the planters and the plants may need to be replaced.  Garbage has increased in and around the waterfront park, mason county garbage is now picking up the garbage once per week.

Public Restrooms: Currently closed to the public as per the COVID-19 pandemic. Portable restrooms with hand washing stations provided by the Port and the Purvis’ are available for the public.

Port Operations Manager Report

The port administrator spoke to the Washington Public Ports Assn, they use Zoom to have their virtual meetings, they suggested paying $15.00 per month to allow an unlimited zoom session with additional security.  The port commission agreed that would be a necessary cost during the COVID 19 meeting restrictions.  The port administrator said she and Wittenberg CPA have been working on the annual Schedule 22 state audit. The Port of Hoodsport port commission is using ‘Zoom’ virtual chat room venue for public meetings during the COVID-19  to adhere to social distancing mandates.  Meeting dates are posted on the port’s website, picked up by MasonTV, WPPA newsletter and is posted on the port office window.  A zoom invitation will be sent to anyone requesting to be present at a regular port meeting. Current Port meeting protocol requires the agenda to have two sections reading “Necessary and Routine” and “Necessary and Routine Topics and Actions in Response to COVID-19 Outbreak”.
